  • Railways’ New Catering Policy 2010

    A new Catering Policy 2010 of Indian Railways has been introduced w.e.f. 21st July, 2010 which has revised policy guidelines regarding management of mobile as well as static catering units.

    The management of providing onboard catering services to the railway passengers on Indian Railways is now to be done by the Zonal Railways instead of IRCTC, in a phased manner.

    During the current year from January to 20th July, 2010, a total number of 687 complaints have been received regarding sub-standard food and contaminated water.

    Number of Complaints received from North Zone i.e. Northern Railway, North Central Railway, North Eastern Railway and North Western Railway is 257; from West Zone i.e Western Railway, Central Railway and West Central Railway is 105; East Zone i.e. Northeast Frontier Railway, Eastern Railway, South Eastern Railway, South East Central Railway, East Central Railway and East Coast Railway is 180; South Zone i.e. Southern Railway and South West Railway is 113 and South Central Zone i.e. South Central Railway is 32.

    Following steps are taken to maintain quality of food and mobile as well as static units:-

    1. Modernization of base kitchens and cell kitchens where food is prepared for onward transmission to mobile unit.

    2. Conducting special drive on premium trains and base kitchen.

    3. Conducting 3rd party audit by reputed agencies.

    4. Customer satisfaction surveys.

    5. Web enabled complaint management systems.

    6. Toll free number to lodge complaint.

    This information was given by the Minister of State for Railways, Shri K.H. Muniyappa in a written reply in Lok Sabha today.

  • The case is settled, in 30 minutes

    The hammer came down in 30 minutes, the case was settled and Baban
    Londhe went home a happy man.

    Baban, a resident of Eklahare village in Ambegaon taluka, had been
    fighting a court case against his younger brother Manohar Londhe for
    the last three years—Manohar had allegedly encroached upon his
    brother’s land, building a cattleshed and a godown. The case was being
    heard in the Ghodegaon judicial magistrate first class (JMFC) court,
    about 30 kilometres from Baban’s village. But on July 17, Saturday,
    the case was put before the mobile Lok Nyayalaya (public court) held
    at Kalamb village, barely two kilometres from Eklahare, and Baban won
    the case. Judge SZH Kazi passed an order directing Manohar to remove
    the encroachments.

    The Lok Nyayalaya was held as part of a scheme called ‘Justice at the
    doorsteps’, launched by the Maharashtra State Legal Service Authority
    (MSLSA) this year. A mini-bus converted into a courtroom travels to
    the doorsteps of rural litigants in the state. The bus has been
    touring Pune district between July 5 and 31.

    The mobile court halts at a village that is accessible to 10-15
    surrounding villages. About 50 cases are taken up at each halt. “The
    purpose of the mobile court is to settle such cases at the doorsteps
    of villagers. It is beneficial to them since they don’t have to travel
    long distances to the court and it helps the judiciary reducing case
    backlogs,” says judge R H Mohammad, member-secretary, Pune district
    legal service authority (DLSA).

    Of the 50 cases that were put before the Lok Nyayalaya at Kalamb,
    eight were settled. The unsettled cases go to the Ghodegaon JMFC
    court.

    The order passed by the Lok Nyayalaya is on a par with that passed by
    a regular court. “It is to be strictly abided within the given time
    limit of two months, else a contempt of court may be filed. Moreover,
    since this order is passed with the mutual consent of both the
    parties, there is no scope for appealing against it,” says Kazi.

    Civil and criminal cases pertaining to property-related matters, cases
    of cheques bouncing that fall under the Negotiable Instruments Act,
    1881, and cases in the pre-litigation stage are put up before the Lok
    Nyayalayas.

    Most litigants were happy with the concept of travelling courts. “It
    made us feel that the judge had come to hear our grievance,” says
    Balasaheb Shinde, a litigant whose property-related dispute was not
    settled in Kalamb village.

    But there are lawyers who aren’t convinced about the idea. Mukund
    Walse Patil, who practises in the Ghodegaon JMFC court, says litigants
    are forced to settle their case in the mobile Lok Nyayalayas. “Most of
    the times, the accused are ready to settle the case out of court and
    the complainant is forced to do the same . So the accused almost
    always gets away easy. But if the same case goes to the court, the
    accused is punished, even if it takes longer,” he says.

    But Judge Kazi, who travelled in the van between July 12 and 14, says
    judges always counsel the litigants and talk to them about the need to
    settle their cases in the Lok Nyayalayas. He says litigants were more
    at ease during these court hearings than in the regular court.

    Naina Padwal of the Ghodegaon bar association, who travelled with the
    van in Ambegaon taluka, says the mobile courts have reduced the work
    load of lawyers. “Litigants are relieved, so are the lawyers from
    petty cases. This exercise must be carried out frequently in other
    villages,” she says.

  • HC seeks govt take on admission to disabled

    MUMBAI: The Bombay High Court has directed the Maharashtra government
    to clarify
    its stand on allowing visually challenged and other disabled students
    from pursuing
    professional and health science courses.
    The court was hearing a petition filed by a 17-year-old visually
    challenged Ruparel
    College student who is seeking admission to the physiotherapy course
    at G S Medical
    College attached to KEM Hospital. A division bench of Chief Justice
    Mohit Shah and
    Justice S C Dharmadhikari has sought the information from the
    government by August
    2.
    The judges have also asked the authorities to allow the student,
    Kritika Purohit,
    to attend lectures, even as the bench asked the Directorate of
    Medical Education
    and Research to keep one seat vacant.
    Kritika's lawyers, Jamshed Mistry and Kanchan Pamnani, informed the
    court that she
    had cleared the MH-CET (Maharasthra common entrance test) and medical
    tests and was
    ranked third in the physically challenged category. The government
    sought a year's
    time to make arrangements for visually challenged candidates to take
    the course.
    The court has asked the petitioner's lawyers to make state disability
    commissioner,
    G S Medical College and Maharashtra University of Health Sciences,
    parties in the
    case.
    Kritika, one of the first visually challenged students to get
    admitted to the HSC,
    science stream, in the state, after scoring 82% in her SSC
    examinations, moved the
    High Court when she was barred from appearing for the MH-CET examinations.
    The High Court intervened to allow her to appear for the exams.
    The state pointed to the Medical Council of India rules, which
    specify that only
    a disabled person with a locomotive disability of the lower limb (50%
    to 70%) could
    apply for MBBS courses.
    According to Kritika's lawyers, the state has not applied its mind on
    whether visually
    challenged students can pursue other health science and paramedical
    courses such
    as physiotherapy, which do not involve invasive surgical procedures.
    The Persons With Disabilities Act makes it mandatory for 3%
    reservation for disabled
    persons in college admissions. Students who are visually challenged,
    though, are
    unable to get admissions to several courses, her lawyers have claimed.

University of Massachusetts Medical School (UMMS) researcher Shalesh Kaushal, MD, PhD, chair of ophthalmology and associate professor of ophthalmology and cell biology and his team conducted the study. Results from this study, in conjunction with prior in vitro data, suggest valproic acid may be an effective treatment for photoreceptor loss associated with RP. Five of the seven patients in the study experienced improvement in their field of vision. Because of its already known qualities as a potent inhibitor of the inflammatory response pathway and cell death, valproic acid was believed to have a unique profile making it a potential candidate as a retinal disease treatment. "Repurposing drugs already approved by the FDA and which have been shown to be safe, such as valproic acid, is an economical and time-efficient way to quickly bring new treatments to patients," said Kaushal.     iv) Only such person would be eligible for reservation in services / posts who suffer from not less than 40% of relevant disability and is certified by a Medical Board appointed by the Central/State Govt.

    The visually impaired candidates and candidates whose writing speed is affected by cerebral palsy can use their own scribe at their cost during the written examination. In all such cases where a scribe is used, the following rules will apply:

    i)The candidate will have to arrange his/her own scribe at his/her own cost.
    ii) The academic qualification of the scribe should be one grade lower than the stipulated eligibility criteria
    iii) The scribe can be from any academic discipline. The scribe should possess less marks than the candidate and not more than 60% marks in his own academic stream
    iv) Both the candidate as well as the scribe will have to give a suitable undertaking, confirming that the scribe fulfils all the stipulated eligibility criteria for a scribe as mentioned above.
    Further, in case it later transpires that he/she did not fulfill any of the laid down eligibility criteria or suppressed material facts, the candidature of the applicant will stand cancelled, irrespective of the result of the written examination.
    v) Such candidates who use a scribe shall be eligible for extra time of 20 minutes for every hour of the examination.

    Blindness refers to a person who suffers from either of the following conditions:

    a. Total absence of sight,

    A person with Low Vision means one with impairment of visual functioning even after treatment of standard refractive correction but who uses or is potentially capable of using vision for the planning or execution of a task with appropriate assisting device.

    RELAXATION IN UPPER AGE LIMIT:
    The candidate should have completed a Minimum age of 18 years and should not have completed a Maximum age of 28 years as on 30/06/2010

    Persons with Disability (PWD) by 10 years on cumulative basis. The cumulative age relaxation for PWD category candidates will therefore be (a) by 15 years (10 + 5) for SC/ST; (b) by 13 years (10 + 3) for OBC; and (c) by 10 years (0 + 10) for General Candidates, subject to such cumulative relaxation not taking the age of the candidate beyond 50 years as on 30.06.2010.

    Educational Qualifications :

    The candidate should possess the following qualifications as on 30.06.2010.

    Pass with 50% marks in the aggregate, either in the Higher Secondary School (HSC) Examination or Standard XII under the 10+2+3 pattern or Standard XI under the 11+4 pattern or its equivalent of recognized Educational Board, acceptable to the Bank or a degree from UGC recognized University (Graduation level) .

    Candidates’ having completed Foundation Course on Computer Awareness & Office Automation for duration of minimum 3 months from a Computer Institute, is desirable. The requirement of having completed the said Course will be waived in case of those candidates having Computer subject as part of the curriculum at the Pre- Degree / Degree level.

    Knowledge of Regional Language of a particular State / Union Territory for which candidate apply, is essential.

    (a) HSC Passing Certificate and
    (b) University FINAL DEGREE Passing (CONVOCATION) Certificate.     Accessibility of mobile phones and devices has generated a lot of
    interest among blind and partially sighted people in recent times.
    Compared to 5 or 6 years ago, the choice of accessible phones has
    significantly improved.

    in addition to 3rd party screen reading and screen magnification
    solutions for Symbian Series 60 based Nokia phones, we now have Apple
    iPhone 3GS and iPhone 4 which have a screen reader and screen
    magnification software built-in, there by providing access out of the
    box at no extra cost. There are also accessibility solutions in
    development for Google's Android based smart phones and Blackberry
    devices from Research in Motion. With all these options and the mobile
    technology evolving continuously at a rapid pace, it is extremely
    important for end users with visual impairments to understand all the
    available alternatives to make an informed choice.

    Further, most mobile phones these days can perform a number of useful
    tasks other than voice calling and text messaging. These so called smart
    phones and super phones are capable of providing access to your diary,
    keep track of your tasks, provide satellite based navigation as well as
    double up as media players.

    Phone Watch is a series of short (about 2 hours each) and highly
    interactive sessions where we aim to provide end users with information
    and where ever possible, demonstrate all the latest developments in the
    field of mobile devices and technology. Additionally, we also aim to
    provide useful information and tips on how to make more use of your
    phone's capabilities. Since the sessions are highly interactive,
    participants are encouraged to exchange ideas and information which
    could perhaps be documented to benefit other end users with visual
    impairments.

    The first of these Phone Watch sessions will be held at RNIB's
    Judd Street office on Friday, the 30th of July from 5:00 pm to 7:00 pm. if
    you are interested in participating, please let the organisers know at
    the earliest as places are very limited.

    The provisional agenda for Phone Watch 1 is as follows:
    * Welcome and introduction to Phone Watch - Robin Spinks,
    Principal Manager, Digital Accessibility at RNIB.
    * Demonstration of Vodafone Speak, an on-demand, over the air

    Background

    In today's knowledge society,the accessibility of content is key to
    Socio-Economic growth. The Creation of useful and relevant content in local
    language is not enough. It is important that this content is presented to
    the end user in the format that they are most comfortable to access it in.
    The digital technology for storage and dissemination of content is extremely
    dianamic and has opened up many new possibilities for making content
    accessible to all in their preferred format. How ever,convertability,
    adhering to standards such as UNI-code etc. adaptability to various devices
    etc. are few key elements to realize the full potential ofthis technology.

    DAISY Consortium for formed in 1996 and has developed standards for
    accessible digital content. The consortium has also facilitated development
    of tools for production, distribution and playback of digital content in the
    user preferred formats. DAISY Consortium members from all round the world
    have implemented these standards to provide accessible content services in
    their countries and are moving steadily towards formation of global
    accessible digital library.

    Leading experts from all over the world are getting together to share their
    knowledge in this International DAISY Technical Conference which will be
    held in New Delhi on October 28 - 29, 2010. This is a golden opportunity for

    INTRODUCTION

    The XRCVC and the Tech Mahindra Foundation are happy to announce the
    Scholarships for the year 2010 - 2011. The XRCVC-Tech Mahindra
    Foundation Scholarship is a financial support for the visually
    challenged students pursuing higher education who meet the eligibility
    criteria of the scholarship.

    The scholarship hopes to help the candidate to overcome any financial
    obstacle that may limit their further education and success. The
    scholarship aims to specially support students pursuing professional
    post graduate education though is open to other needy students as
    well. We wish that with this right support the deserving candidates
    will be able to excel in the professional field of their choice making
    a mark for themselves and being an inspiration for others.

    ELIGIBILITY CRITERIA FOR THE SCHOLARSHIP

    In order to qualify for applying for the XRCVC-Tech Mahindra
    Foundation Scholarship the terms as decided by the funder are the
    following:

    1. The Annual family income of the candidate should be less than Rs
    3,00,000.00 (Income certificate needs to be attached)
    2. The candidate should have already secured admission in the course
    of their choice. (photocopy of the admission receipt and/or identity
    card needs to be attached)
    3. The candidates past academic performance has met a minimum of 50%

    4. The candidate has a vision disability (photocopy of the disability
    certificate to be attached)

    APPLICATION PROCESS

    Interested candidates who meet the above criteria need to fill and
    submit the attached Application Form to the XRCVC, St.Xavier’s
    College, Mumbai latest by 23rd August 2010.

    The short listed candidates will go through an interview screening.
    The final decision will be made solely by the selection committee.
    The committee will not entertain any further correspondence in this
    regard. In case of a physical interview candidate needs to be present
    on his/her own expenses.

    SCHOLARSHIP SPECIFICATION

    Selected candidates will be awarded a scholarship of up to Rs
    50,000.00 based on candidate’s application and need. The scholarship
    money will be granted solely for the purpose of meeting the following

    The scholarship grant will be made in two instalments. The awardees

    We are conducting a research project at the University of Maryland Baltimore County (UMBC), to identify the strengths and weaknesses of screen readers for cellular phones (e.g. Nuance Talks, SmartHal, MobileSpeak, Oratio, in-built screen readers such as Voice Over etc). We are looking to perform phone-based interviews with users, with the aim of designing a system to address the challenges faced.

    We are looking for both expert users and people who have recently started using mobile screen readers too. Interviews will be scheduled at a convenient time for you in the course of the next two to three weeks. All information will be kept securely.

    While there are no specific academic pre-requisites for candidature, basic literacy and communication skills [verbal/non verbal] are necessary. Higher education will be a definite plus.

    We request that only those who are physically and mentally capable of working in a regular environment with necessary training and support must attend. People with serious disabilities desiring employment are requested to email their resumes specifying their abilities and disabilities to us for later perusal.
